What is private real estate lending?
A private lender provides funds to a borrower for a real estate project. The loan documents explain repayment, timing and other terms. Lending is different from buying the property or owning part of the project.
What should you review?
Look at the borrower’s experience, the property, the project budget and the repayment plan. If collateral is proposed, review its value, title and lien position. Collateral does not eliminate the risk of loss.
Understand the documents
A promissory note sets out the repayment obligation. A mortgage or other security document may be used when a loan is secured by real estate. Have your legal and financial advisers review the documents, recording requirements and rights before you commit.
Questions to ask before lending
- How will the funds be used?
- What is the repayment plan and maturity date?
- What collateral, if any, supports the loan?
- What happens if the project is delayed or the borrower cannot repay?
- Who handles closing, documents and disbursement?
